The CIC directed secretary of Department of Women and Child Welfare at GNCTD to put out on its website, details of those who have been given pension and those who have been rejected. This is the 196th in a series of important RTI judgements given by former Central Information Commissioner Shailesh Gandhi
The Central Information Commission (CIC), while allowing an appeal, directed the Public Information Officer (PIO) as well as secretary of Department of Women and Child Welfare at Government of National Capital Territory of Delhi (GNCTD) to upload details of people who received pension from the government on its website.
While giving the judgement on 12 June 2009, under the Right to Information (RTI) Act, Shailesh Gandhi, the then Central Information Commissioner, said, "PIO to ensure that names and addresses of people who apply for the various pension schemes are put up on the website every fortnight. The secretary of Department of Women and Child Welfare should ensure this before 15 July 2009."
Delhi resident, Yasmeen Begum, on 27 December 2008, sought from the PIO information regarding action taken on her application dated 10 September 2008 for pension for widow. Here is the information she sought...
1. Daily wise report of action taken on my application dated 10.09.2008 for 'pension for widow'.
2. Name of officers who had the application and how long they had and what action they took.
3. Name of officers and their post that had to take action but not did so.
4. What will action be taken on them and how long it takes?
5. In how many days will action be taken on my application?
There was no mention of any reply provided by the PIO.
Yasmeen Begum then filed her first appeal. During the hearing, the First Appellate Authority (FAA) directed the joint director of FAS to provide the information to Begum within 15 days from his order.
The appellant then approached the CIC with her second appeal.
During the hearing, before Mr Gandhi, the then CIC, the PIO showed that he had given the information to Begum as well as ensured that the pension is remitted to her.
While allowing the appeal, the Bench directed the PIO to ensure that names and addresses of people who apply for the various pension schemes are put up on the website every fortnight. "The details of those who have been given the pension and those who have been rejected should also be put up on the website," Mr Gandhi said in his order.
