In a family dispute, four owners with EQUAL share of a Flat in Co operative Housing Society that is going for redevelopment. The flat was purchased by four us with my name as the first one is share certificate.. Father, mother and daughter(me) are willing for redevelopment. However, the son(my brother) is not willing to sign ANY documents ,development agreement, Permanent Alternate Agreement, consent letter etc. The family is trying to persuade my brother to co operate. The society informs verbally that if ALL FOUR do not sign, then We may be considered dissenter and Registration of documents will have to be carried out by us at our cost, otherwise the developer is agreeable to register all flat owner's documents at his cost.
I stay in the flat. Father¬mother stay in another flat in another building, brother stays out of Mumbai.
Although We are willing, can the society/developer refuse to carry out registration of documents? Can the documents be registered with my signature only or ALL FOUR of us have to sign. As I stay, as I pay all property taxes etc since last 10 years, as I attend all meetings and my name is first in the share certificate.
